Right To Buy – Common Sense Prevails In Definition Of Premises


The right of a tenant to buy his or her property (under the Leasehold Reform, Housing and Urban Development Act 1993) is now well known. The right, however, does not apply in all cases and one of the exceptions is that a landlord may refuse to sell a property if it is the landlord’s intention to redevelop the premises.

Recently, a tenant’s application to buy his flat, which was one of a block of 50 in a nine-storey building, was refused by the landlord on the grounds that he intended to redevelop the premises, in this case by making the flat into a ‘duplex’ including the flat below.

The relevant section of the Act allows the landlord to resist an application if the landlord intends to ‘redevelop any premises in which the tenant’s flat is contained’, but only in cases in which the construction works are carried out on a ‘substantial part of any premises in which the tenant’s flat is contained’.

At issue was what was actually meant by the phrase ‘any premises in which the flat is contained’. In the view of the landlord, it meant any definable part of the building which could be shown on a plan. The tenant, however, argued that ‘premises’ meant a recognisable part or area which contains the flat in question. In essence, this argument is that if a space is one which a visitor would recognise as constituting premises, then that space or area counts as premises for the purposes of the Act. If, on the other hand, a visitor would not recognise the ‘separateness’ of that space or area, it is not premises. The House of Lords agreed that this must be the test, since it could not have been the intention of Parliament to allow landlords to define what constitutes premises, in such circumstances, according to their own wishes.

In the case in point, the Lords considered that a visitor to the block of flats would consider the block as a whole to be the premises, not the tenant’s flat plus the flat below it. In this case, therefore, the landlord’s claim failed, since the premises as a whole were not subject to redevelopment plans.

The Financial Markets Rescue Bill and How it Impacts Your Taxes


Earlier this month, the President signed into law the Emergency Economic Stabilization Act of 2008. The financial markets rescue plan is one of the main components of the new law, but the new law also includes over 100 tax provisions!

HOW THE NEW LAW IMPACTS YOUR TAXES:

Here are a few of the highlights to help you determine how your taxes are impacted:

- Mortgage Forgiveness Debt Relief Act of 2007 Extended

This mortgage forgiveness law, enacted in late 2007, was originally set to expire at the end of 2009. The new law extends it through 2012. The law excludes from tax all or a portion of income resulting from the forgiveness of debt on a principal residence resulting from a foreclosure, mortgage workout, short sale or deed-in-lieu of foreclosure.

- AMT Patch

The AMT patch is intended to insulate middle-income taxpayers from AMT. The patch is only effective for 2008. Since the patch is currently only effective for 2008, it makes it even more important to consider the impact of it now on your overall tax strategy.

The patch allows the dependent care credit and education credits to be taken against AMT liability. Prior to this patch, these credits could not reduce the AMT liability.

The new law also provides some relief to those who are subject to AMT or have minimum tax credits from the exercise of incentive stock options.

- Child Tax Credit Improved

The new law lowers the earned income floor on which the refundable portion of the credit is calculated. The end result is a higher portion of the credit being refundable.

- Research Tax Credit Extended

The new law extends the research tax credit to amounts paid or incurred in 2008 and 2009. The new law also increases the credit percentage from 12% to 14%.

- Leasehold and Restaurant Improvements

Qualifying restaurant improvements and leasehold improvements are eligible for 15 year depreciation rather than 39 year for two more years through 2009. In addition, certain improvements to retail space are eligible for 15 year depreciation.

- State and Local Sales Tax Deduction Extended

Previous law allowed individuals to deduct state and local general sales taxes in lieu of state and local income taxes. This expired at the end of 2007. The new law makes the deduction retroactive for 2008 and continues the deduction through 2009.

- Tax-Free Distributions from IRAs for Charitable Purposes

The new law allows taxpayers to make tax-free distributions up to $100,000 from their IRAs for charitable purposes. This provision expired January 1, 2008 but the new law extends it through 2009.

- Additional Standard Deduction for Real Property Taxes Extended

Also extended through 2009 is the additional standard deduction amount allowed for real property taxes for those taxpayers who do not itemize.

- Higher Education Tuition Deduction Extended

The higher above-the-line education tuition deduction is extended through 2009. The maximum deductible amount is $4,000 for taxpayers with adjusted gross income less that $65,000 ($130,000 for joint filers) and $2,000 for taxpayers with adjusted gross income between $65,000 and $80,000 (between $130,000 and $160,000 for joint filers).

What Exactly Are Home Information Packs?

Introduction to Home Information Packs

In 2004 the home information pack (HIP) was introduced in England and Wales as a mandatory document that is needed to be produced before a property can legally be bought or sold. It was introduced to stabilise the sale process and includes documents such as the energy performance certificate, sustainability document (for new houses only), sale statement (which includes the address being sold, the capacity of the seller etc) and proof of property ownership. If the property is leasehold or commonhold it will also require documents such as a copy of the lease, landlord contact details and recent service charge receipts. The average cost of the HIP’s documentation has been estimated at around £300 to £600 for the majority of houses within England and Wales, but this isn’t all a new additional cost as the majority of these expenses were present in past systems. At the moment the failure to produce a complete HIP document results in a fine of £200. The seller is always responsible for the cost of the HIP; it must always be in place when the property is available on the market and be with the group associated with advertising the property. A home information pack can be commissioned from a variety of sources, including estate agents, solicitors, specialist hip providers or you can just compile it yourself, but make sure it includes all of the necessary documentation. The HIP’s document is always free to receive and you should receive it within 14 days of the request. There are only a few circumstances in which a HIP is not required, for instance non-residential properties or the sale of holiday accommodation.

Home Condition Report

The initial idea was that a home condition report would be included in any HIP document; this document would detail the condition of the property, avoiding miss-understanding with any problems with the property totally visible to the buyer. These reports are to be carried out by certified home inspectors to enable all property reviews to be standardised with similar quality levels, this isn’t mandatory at this moment but may become so in the future.

Energy Performance Certificate

This document is designed to provide the house purchaser with the ability to assess the properties energy consumption, these as with the home condition report need to be undertaken by an official third party, and in this case a qualified Domestic Energy Assessor (DEA). This process is in place to improve the energy performance of homes within the buying and selling process, this has the benefit of improving the energy consumption of houses and saving on energy bills for the buyers. This is a required part of the HIP’s documentation.
